- Do both parties have to sign an amendment in Montana?
- Yes. An unsigned draft does not change the lease. Keep the original lease and attach signed amendments so the full agreement is clear later.
- Can an amendment waive deposit-return rules?
- No. Montana does not cap how large a residential security deposit may be. If the landlord makes no deductions, unused deposit is generally due within 10 days; if deductions are taken, an itemized list is generally due within 30 days (Mont. Code Ann. § 70-25-202). An amendment cannot strip away mandatory Montana landlord-tenant protections.
