- A lease amendment is a short writing that changes specific terms of an existing lease — rent, end date, occupants, pets, or parking — without rewriting the whole contract.
- Do both parties have to sign an amendment in Delaware?
- Yes. An unsigned draft does not change the lease. Keep the original lease and attach signed amendments so the full agreement is clear later.
- Can an amendment waive deposit-return rules?
- No. For a rental agreement of one year or more, the security deposit generally may not exceed one month’s rent (Del. Code Ann. tit. 25, § 5514). Hold it in escrow. Unused deposit plus an itemized list is generally due within 20 days after the tenancy ends. An amendment cannot strip away mandatory Delaware landlord-tenant protections.
