- A lease amendment is a short writing that changes specific terms of an existing lease — rent, end date, occupants, pets, or parking — without rewriting the whole contract.
- Do both parties have to sign an amendment in Arizona?
- Yes. An unsigned draft does not change the lease. Keep the original lease and attach signed amendments so the full agreement is clear later.
- Can an amendment waive deposit-return rules?
- No. A landlord may not demand security, including prepaid rent, of more than one-and-a-half months’ rent (A.R.S. § 33-1321). Nonrefundable fees must be labeled in writing or they are refundable. After the tenancy ends and the tenant returns possession, the unused deposit and an itemized list are generally due within 14 days, excluding weekends and legal holidays. A move-in condition form is required. An amendment cannot strip away mandatory Arizona landlord-tenant protections.
