Nebraska Pet Addendum
This Nebraska pet addendum lets a tenant keep named animals on an existing lease. Nebraska generally caps a security deposit at 1× monthly rent. A pet deposit is still refundable unless it is clearly labeled a nonrefundable fee, and it must be accounted for with the rest of the deposit. Assistance animals required by fair-housing law are not pets and cannot be charged a pet deposit or pet rent. It does not replace the lease, and it does not apply to assistance animals.
- Nebraska allows an extra pet deposit of up to one-fourth of one month’s rent on top of the one-month security deposit (Neb. Rev. Stat. § 76-1416).
- Unused deposit money is generally due within 14 days (Neb. Rev. Stat. § 76-1416).
- Assistance animals are not pets. Do not use this addendum to charge a deposit or rent for one.
