- Do both parties have to sign an amendment in Virginia?
- Yes. An unsigned draft does not change the lease. Keep the original lease and attach signed amendments so the full agreement is clear later.
- Can an amendment waive deposit-return rules?
- No. A security deposit generally may not exceed two months’ rent (Va. Code Ann. § 55.1-1226). Unused deposit plus an itemized list is generally due within 45 days after the tenancy ends. An amendment cannot strip away mandatory Virginia landlord-tenant protections.
