20 days after the tenancy ends
For a rental agreement of one year or more, the security deposit generally may not exceed one month’s rent (Del. Code Ann. tit. 25, § 5514). Hold it in escrow. Unused deposit plus an itemized list is generally due within 20 days after the tenancy ends.
A month-to-month tenancy generally takes 60 days’ written notice (Del. Code Ann. tit. 25, § 5106).
Except in an emergency, the landlord must give at least 48 hours’ notice before entering (Del. Code Ann. tit. 25, § 5509).
A Delaware rent increase should be in writing. Many landlords use at least the same notice they would use to end a month-to-month tenancy. A month-to-month tenancy generally takes 60 days’ written notice (Del. Code Ann. tit. 25, § 5106). The lease may require more. Local rent-control rules can cap the amount even when the notice period is met.
